1.Scope of the contract

The current “Terms and conditions of purchase” apply to all the products of Malaka Glass through this website. Malaka Glass informs that its website is directed exclusively to an audience over 18 years old, you guarantee us that you are over 18 years old and that you have legal capacity to enter into binding contracts.

Malaka Glass reserve the right to cancel fraudulent, false or speculative orders as well as those orders that have been requested by a customer with which there may be a difference / controversy in previous orders, or when there are reasonable doubts that the customer is infringing any of the specified purchase conditions or is participating in any criminal activity.

Malaka Glass is allowed to modify the contents without notice, just as eliminate or changed them within the website, as well as its access, freely and without justification, not being responsible for the consequences that may cause to the users.

2.Pricing

In accordance with current legislation, all purchases from our website will be subject to value added tax, except for the Canary Islands, Ceuta and Melilla. The applicable rate will be the legally valid at all times. In the case of purchases made by individuals, VAT is included in the price.

All prices are quoted in euros (€) and must be considered as the final price to be paid by the customer (including VAT or not depending on the delivery territory, as indicated in the previous paragraphs). Transportation costs (if applicable) as well as taxes and fees for the entry and exit of the product in the Canary Islands, Ceuta and Melilla are not included in that price.

Purchases to the Canary Islands are exempt of VAT, but the customer must assume the taxes and expenses of entry and exit of the product in their Community (IGIC, customs clearance, etc.). These expenses must be paid directly by the customer to the logistics operator in charge of delivering the product. In the same way, the client must assume the cost of the exit of the product from his community (customs clearance) when the order is returned.

The amount of the shipping costs is indicated to the customer in a disaggregated way at the moment of placing the order.

3.Payment

Any order placed must be paid for immediately after confirmation of the order. Orders will only be submitted for which payment has been completed and verified.

4.Shipping

Delivery can be made to the address of your choice (except for PO Box) or picked up from our studio. To do this, you must select "Collect at Studio" during the purchase process.

The shipping costs will correspond to the buyer and will be added to the price of the product purchased. We will informó you about the shopping costs before your order finalizes. If you choose to pick up your order from our studio, shipping costs will be always free.

If when receiving your order, the packaging is damaged, you must open the package in the presence of the logistics operator to check the condition of your order. If damage is observed, you must detail it on the delivery note and contact our Customer Service.

Once the order has been delivered, it will become your property and therefore all damages that may arise will be your responsibility.

5.Returns, exchange & withdrawal

Items purchased through the online store can only be exchanged, returned or withdrawn through the same channel.

1. All products to be exchanged or returned must be properly packaged.
2. In case of withdrawal, you will only be responsible for the value decrease of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods

In any of the above cases you have 7 working days to return the items you have purchased. The costs arising from the exchange, return or withdrawal shall be assumed by the buyer.

6.Product Availability

If there are any incidents with regards to the supply or if there are no products left in stock, the customer will be informed immediately and the amount of the product or products without stock will be refunded. Malaka Glass will reimburse the corresponding amount without undue delay and, in any case, before 14 calendar days have passed. The refund will be made by the same means of payment with which it was paid. The data on the availability of stock in the physical store reflected on our website are indicative and may vary.

9.Force Majeure

'Malaka Glass' performance of all or part of its obligations will be suspended in the event of an unforeseen event or force majeure that prevents or delays performance. The following, in particular, will be considered as such, without this list being restrictive: war, riots, insurrection, social disturbances, strikes of any nature and supply problems not attributable to Malaka Glass.

Malaka Glass will inform the client of any such acts of God or force majeure within seven days of their occurrence.
